Carefully Read the Contracts

            As a contractor and real estate broker I have to use a lot of contracts. But I am not always the one initiating these contracts. Therefore, I must carefully read each of these contracts for the term and conditions of them. AS a general contractor sometime, a sub wishes to try and push their contract by me, even though I will use my contracts to form our contractor/sub-contractor relationship I will read their contract to see if there is something I should add to mine terms and conditions.  

People love to tell you how they wish to or always perform in good faith but if the contract does not spell these terms out you do not have a contract to enforce their words. Take the time to get it in ink, it is so much easier to enforce what has been written down.

As a real estate broker, it is my duty to read the contracts and make certain that my clients understand what they are signing and if the offer or counter offer is a fair one. I am to advise them as to what constitutes a fair deal for them. I am not a sub agent of the seller; I would be the buyers or seller’s broker. As such my loyalty and fiduciary responsivity is to my client. Therefore, I read every word of these contracts and inform my client what is being offered. I give them time to read and consider the contract, offer or counter offer and I offer an opinion when asked. I also believe that a wise client asks for the opinion of their agent or broker.

I keep these contracts and forms in order and I present my clients s with the copies of the forms and contract. Many times I sit down with them and we fill out the forms together, other times I ask them to read the information and ask questions to make sure they understand the terms and conditions of te forms and contract.

I agree it takes a little longer to get through the process this way, but it is a lot quicker to get through court if the demand is made. Trials are painful and court is nerve racking but if you can present your case who you delivered on all you promised by fulfilling your fiduciary responsibilities the case seems to go a lot quicker and in the right direction.

The bottom line is carefully read your contracts to insure there are no surprises. Then simple live up to the agreement you’ve made.
